Hourly rate

The hourly rate is the salary divided by 220 for those who work 44 hours a week, the maximum set by the Constitution (Constituição Federal, art. 7º, XIII), and by 200 for 40 hours (Súmula 431 of the TST, the Superior Labor Court, according to the TRT-MG, a regional labor court). For 36 and 30 hours, the calculator uses the same proportion (180 and 150). A collective agreement may set another divisor. Overtime is calculated on the hourly rate including the pay items of a salary nature (Súmula 264 of the TST).

Overtime

An overtime hour is worth at least 50% more than a normal hour (Constitution, art. 7º, XVI; CLT, art. 59, § 1º, the labor code), and up to 2 overtime hours a day are allowed (art. 59). A holiday worked without another day off is paid double (Lei 605/1949, art. 9º): use the second overtime field, at 100%. A collective agreement may set higher rates.

Night-work premium

Work between 10 p.m. and 5 a.m. earns a premium (adicional noturno) of at least 20% over the daytime hour, and the night hour is 52 minutes and 30 seconds long (hora noturna reduzida; CLT, art. 73). That is why each clock hour at night is worth 8/7 of an hour: from 10 p.m. to 5 a.m., 7 hours on the clock make 8 night hours.

Weekly rest reflex

Habitual overtime counts toward the pay of the weekly rest (descanso semanal remunerado; Lei 605/1949, art. 7º, a): the calculator divides the month's amount by the business days and multiplies it by the Sundays and holidays. A night-work premium paid habitually counts the same way, because it is part of the salary for all purposes (Súmula 60 of the TST).

What the calculator does not consider

Overtime worked at night, where the night-work premium goes into the base of the overtime hour; hour banks (banco de horas) and the offsetting of hours; special working schedules and rural work, which has its own rules; and the INSS (social security) and income tax deductions, which apply to these amounts together with the month's salary.
