How the adjustment is calculated
The new rent is the current one multiplied by 1 plus the index's 12-month change divided by 100. With the IGP-M at 2.16% over the 12 months up to August 2026, the factor is 1.0216. When the 12-month change is negative, the math gives a lower amount; whether the reduction applies is for the contract to say.
Which index and which month to use
The ones your contract sets: the Tenancy Law (Lei do Inquilinato) leaves the amount of the rent and the adjustment clause to the agreement between the parties (Lei nº 8.245/1991, arts. 17 and 18), and adjustment by an index cannot be made at intervals of less than a year (Lei nº 10.192/2001, art. 2º, § 1º). Without an agreement, after three years of the contract or of the last agreement, the landlord or the tenant can ask a court to review the rent to bring it to the market price (Lei nº 8.245/1991, art. 19).
